PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION THAT AFFECTS YOUR RIGHTS, REMEDIES, AND OBLIGATIONS. THEY INCLUDE A WAIVER OF CLASS ACTIONS, A BINDING ARBITRATION CLAUSE (UNLESS YOU OPT OUT), LIMITATIONS OF LIABILITY, AND JURISDICTIONAL GUIDANCE. BY USING ORCAR, YOU AGREE TO THESE TERMS.

1. Introduction

Orcar ("we", "our", "us") is a technology company that operates a fullstack, AI-powered car rental platform. We connect verified users ("you") with vehicles owned by licensed rental car partners ("Partners") across Korea and other regions. Orcar manages the entire rental lifecycle—onboarding, verification, booking, payment, vehicle access, and customer support—under exclusive operational rights from our Partners. By using Orcar, you accept these Terms of Service (the "Agreement"), which apply to all activity on the Orcar platform, including browsing, booking, account registration, support interactions, and payment processing.

2. Eligibility, Registration & Verification

2.1 Eligibility Requirements You must: • Be at least 21 years old (or meet legal driving age in jurisdiction of use) • Possess a valid driver's license accepted in Korea • Not have any suspensions, bans, or prior violations on Orcar • Be able to pay via authorized global payment methods • Foreign nationals may book vehicles prior to arriving in Korea using international licenses, phone numbers, and payment methods. 2.2 Account Registration To use Orcar, you must create an account and provide: • Full legal name and date of birth • Valid email address and mobile phone number • Accepted form of identification (passport, national ID, or IDP) 2.3 Driver Verification All drivers must pass Orcar's license verification system. Verification may be instant or manually reviewed if flagged. Orcar reserves the right to reject access at its discretion.

3. Booking, Fees & Payment

3.1 Booking Process Your booking is confirmed only after successful payment and confirmation receipt. All vehicle details, pricing, and return conditions are displayed transparently at the time of checkout. 3.2 Fees The final price includes: • Base rental fee (hourly or daily) • Mandatory insurance coverage (liability and property damage) • Optional add-ons (child seats, extra coverage, etc.) • Applicable taxes and platform charges 3.3 Deposits & Preauthorization Orcar may require a refundable security deposit based on vehicle class or user profile. If no deposit is held, Orcar reserves the right to charge your stored card for post-use damage or violations. 3.4 Refunds & Adjustments • Deposits are refunded within 7 days if no issues are reported • Additional charges (damage, cleaning, tolls, traffic fines) may be billed post-return, with documentation • Users are responsible for foreign exchange losses or bank delays

4. Your Commitments

By using Orcar, you agree to: • Only drive the booked vehicle yourself (or approved additional driver) • Use the vehicle legally, responsibly, and for personal use only • Follow instructions for pickup, return, fuel policy, and cleaning • Immediately report any accidents, damage, or loss You also acknowledge Orcar operates on behalf of licensed vehicle Partners, and that ownership of the vehicles remains with these third-party operators.

5. Content & User Conduct

5.1 Content License You grant Orcar a non-exclusive, royalty-free license to use any content (reviews, images, feedback) you provide to improve and promote the platform. 5.2 Prohibited Conduct Users may not: • Submit false documents or use fraudulent identities • Tamper with telematics or security systems • Smoke in the vehicle or allow pets without authorization • Use vehicles for commercial delivery, off-road driving, or racing

6. Insurance, Accidents & Damage

6.1 Insurance Coverage All rentals include minimum legal coverage. Additional protection options are offered at booking. 6.2 Accidents In the event of an accident: • Notify Orcar immediately via the app or support hotline • Submit photos and a written report within 24 hours • Cooperate with insurance and damage assessments 6.3 Damage & Liability • You are liable for repair costs not covered by insurance • Orcar may charge for vehicle downtime (loss of use) and admin fees • Violations of Terms may result in full liability regardless of coverage

7. Dispute Resolution & Arbitration

By accepting these Terms, you agree to binding arbitration in Seoul, South Korea, for any dispute that cannot be resolved informally. You waive the right to class-action lawsuits or jury trials. Arbitration will follow Korean commercial arbitration rules.

8. Platform Modifications & Termination

8.1 Platform Changes Orcar may update its platform features, prices, vehicle partners, or service offerings at any time. 8.2 Changes to Terms Material changes to these Terms will be posted 7 days in advance and notified via email. Continued use constitutes acceptance. 8.3 Account Termination Orcar may suspend or terminate your account for violations of these Terms. Appeals may be submitted via support.

9. Data Rights & Privacy

9.1 Data Collection We collect, store, and process user data (including driving behavior, GPS logs, booking history, and identity documents) in compliance with Korea's Personal Information Protection Act (PIPA) and international GDPR standards. 9.2 Use of Data Data is used to: • Verify user eligibility and prevent fraud • Improve rental operations • Provide customer support and legal compliance 9.3 Data Sharing Your data may be shared with payment providers (e.g. Stripe), insurance carriers, or law enforcement as required.

10. Governing Law & Contact

These Terms are governed by the laws of the Republic of Korea. Legal disputes will be handled in the Seoul Central District Court unless otherwise required.
